Lawyers for Brittany Pilkington have dropped their demands to remove the Logan County Prosecutor’s Office from their client’s capital murder but they continue to push to move the trial and to open the jury pool beyond the county’s registered voters.
Prosecutor William T. Goslee and his office have given defense attorneys assurances they will have a chance to review grand jury testimony under seal and that statements obtained from Ms. Pilkington regarding her relationship with Joe Pilkington prior to their marriage will not be used in the murder trial.
Defense attorneys Kort Gatterdam, Marc S. Triplett and Tina McFall were arguing the prosecutor’s office violated the 23-year-old defendant’s right to counsel when it sent Diversion Director Annie Kauffman to interview Ms. Pilkington without her attorneys.
Ms. Pilkington is charged with three counts of aggravated murder in the deaths of her three sons over a 13-month period. Each charge carries the possibility of death.
Authorities say she admitted smothering the boys as they slept starting with infant Niall in July 2014 followed by Gavin, 4, on April 6 and infant Noah on Aug. 18.
