A Rushsylvania woman who shot and killed her husband lost an appeal to overturn the results of her December murder trial.
Rosalie Kennedy, 64, maintains there was not enough evidence to convict her and that her attorneys provided ineffective counsel when they failed to suppress statements she made in the back of a Logan County Sheriff’s cruiser and later during an interview with detectives.
She also claimed in the appeal Logan County Common Pleas Judge William T. Goslee erred when he allowed her recorded statements to be introduced as evidence in the trial; failed to instruct the jury on negligent homicide; and failed to redact her statement to investigators that she was willing to take a polygraph test.
Judges with the Third District Court of Appeals rejected all of the arguments.
