A Champaign County judge denied Ely Serna’s motion to throw out his confession to a Jan. 20, 2017, shooting at West Liberty-Salem High School, clearing the way for prosecutors to use it during trial.
Judge Nick A. Selvaggio found Serna, now 18, knowingly, intelligently and voluntarily waived his Miranda rights during a 63-minute interview with Champaign County Sheriff’s Detective Glenn Kemp.
Kemp was never threatening nor confrontational during the interview and was more conversational, the judge found in his 31-page ruling that analyzed a recording of the interview and reports of a forensic psychiatrist and a forensic psychologist.
