A Lakeview man who said he is serious about getting off heroin opted to spend his birthday in jail instead of going forward with a furlough request.
Anthony J. Lowery, who is celebrating his 33rd birthday today, told Logan County Common Pleas Judge Mark S. O’Connor on Monday that after nearly dying of an overdose in November he did not want to risk the possibility of relapsing on heroin while waiting for a bed to open at the West Central Community Correctional Facility.
“I’m afraid what will happen if I get released now,” Mr. Lowery said after entering a guilty plea to a fifth-degree felony drug possession charge. He had already been screened for the Marysville rehabilitation program and is scheduled for a bed on Feb. 11.
Defense attorneys, however, had also filed a request for temporary release from jail until nearer that date, but Mr. Lowery said it was not in his best interest.
Judge O’Connor agreed with the recommendation by prosecutors and defense attorneys that the community corrections route, along with five years of community control, was the appropriate sentence.

• Misty Janes, 23, of Bellefontaine, entered a guilty plea to a fifth-degree felony count possession of drugs for having four prescription opiate pills in her possession during a Nov. 4 domestic dispute at the Rushsylvania One Stop, 125 N. Sandusky St., Rushsylvania.
She threatened her father-in-law Duane Sams with a box cutter after he refused to take her to Kenton, according to initial reports from the Logan County Sheriff’s Office. She has previously pleaded guilty to domestic violence and disorderly conduct in Bellefontaine Municipal Court and was given 30 days in jail and a $700 fine.
Sentencing on the felony was set for Feb. 29.
• John W. Anderson Jr., 54, of Bellefontaine, entered a guilty plea to a fifth-degree felony count of possession of cocaine and was placed on a three-year intervention in lieu of conviction program.
He was arrested by officers of the Bellefontaine Police Department after a traffic stop in the 200 block of west Brown Avenue on Oct. 23. During a search of his vehicle and clothing, officers found cocaine, marijuana and a prescription opiate pill.
• Kail Guyan, 27, of Lakeview, was placed on intervention after admitting to fifth-degree felony counts of possession of heroin and theft of a credit card and a misdemeanor possession of drug abuse instruments.
His mother reported he took a credit card without permission and made $60 in purchases. He was arrested July 7 in connection with that crime and a small amount of heroin and paraphernalia for abusing the drug were located in his possession.
• Emma Schoenberger, 24, of Lakeview, entered a guilty plea to a fifth-degree felony count of possession of cocaine. She was arrested by officers of the Bellefontaine Police Department on a warrant on Nov. 2 and found in possession of the drug. She is awaiting a bed at West Central Community Correctional Facility.

William R. Keller, 40, of Lakeview, who had previously pleaded guilty to his sixth charge of operating a vehicle under the influence of alcohol or drugs was sentenced to a mandatory 120 days in the Logan County Jail, ordered to pay a $1,350 fine and had his driver’s license suspended for two years.
He was arrested by deputies of the Logan County Sheriff’s Office in May after a report that a vehicle struck a parked car on State Route 235 near Sunview Avenue on the north side of Indian Lake.
• Robert Ferguson, 46, of Russells Point, was ordered to spend six months in the Logan County Jail for two counts of trafficking in prescription drugs, both fourth-degree felonies. He also was placed on community control for five years.
Detectives with the Logan County Joint Drug Task Force charged Mr. Ferguson in connection with multiple undercover drug buys in late March. He admitted to selling prescription opiate pills to an informant.
Judge O’Connor said he was reluctant to place Mr. Ferguson, who he said has nine prior felony convictions, on community control and warned him that any violation would result in the maximum three-year prison sentence.
• Robert Conkle, 46, of Bellefontaine, was placed on three years’ community control for two counts of nonsupport of dependents.
