A Colorado doctor was cleared of a perjury charge for testimony he provided in a local malpractice lawsuit.
Logan County Common Pleas Judge Mark S. O’Connor ruled Dr. Michael Hall, M.D., 65, of Englewood, Colo., was not guilty of perjury, a third-degree felony, as part of Tuesday’s bench trial.
“To prove perjury, the law requires prosecutors to show it was done knowingly or with conscious disregard of the truth,” defense attorney Richard Kerger said Friday.
“He was deposed in Colorado for a case that had nothing to do with the Logan County malpractice case and got flustered. He simply made a mistake.”
Dr. Hall is one of small group of expert witnesses in the nation regarding brachial plexus injuries at birth.
This injury damages the nerves that control muscles in the shoulder, arm and/or hand. The most extreme injury leaves the child with no use of the affected arm.
The damage occurs, according to plaintiff lawyers, by improper manipulation of the child by medical staff after the child has entered the birth canal.
He was part of an unsuccessful lawsuit against Mary Rutan Hospital which took place in October.
