CINCINNATI (AP) — An Ohio man who fatally slashed the throat of a 19-year-old woman in her home more than 30 years ago could be spared from execution because he didn't rape her.
Ohio's 1st District Court of Appeals is set to decide in March whether 54-year-old David Steffen (STEPH'-en) is eligible for the death penalty.
Once that's decided, The Cincinnati Enquirer (http://cin.ci/1jpgL3U) reports that Steffen will be re-sentenced in Hamilton County court.
Steffen was convicted of the 1982 aggravated murder and rape of 19-year-old Karen Range in Cincinnati.
He was exonerated of the rape in 2008 through DNA tests. Steffen's attorneys argue that he was sentenced to death based in part on the added rape conviction.
