CINCINNATI (AP) — An Ohio man convicted of rape, kidnapping and attempted murder in the 2007 case of a toddler taken from her bedroom and later found in a ditch has lost a challenge to his life sentence.
A three-judge panel with the 6th U.S. Circuit Court of Appeals in Cincinnati on Tuesday upheld a lower court's ruling regarding 50-year-old Randy Dillon of Zanesville.
Dillon argued that he wasn't able to present a complete defense at trial and that his conviction was based on insufficient evidence.
The judges disagreed, ruling that Dillon got a fair trial and that there was evidence the toddler had been raped. Of the attempted murder charge, the judges say leaving the toddler in a ditch on a winter night could reasonably constitute a significant step toward committing murder.
