TOLEDO, Ohio (AP) — An Ohio hospital is denying a family's allegations of medical negligence over a botched kidney transplant. And the University of Toledo Medical Center is asking the Ohio Court of Claims to dismiss the case.
The hospital has said a nurse accidentally threw out a viable organ donated by a Toledo man for his sister in August 2012. She later received a different kidney in Colorado.
A complaint by the siblings and their family alleges the Toledo facility was negligent and caused emotional distress for the patients' parents. It also says the parents and other siblings lost the pair's comfort and companionship because of the alleged negligence.
In court filings, the hospital denies the claims, seeks dismissal and says Ohio law doesn't provide for recovering damages for such alleged losses by relatives.
