A federal judge has decided he will not reconsider his decision to toss out as evidence five machines seized from Todd Lamb in 2007.
It is one of several recent filings in the federal cases against the 38-year-old Bellefontaine businessman.
His side has filed motions asking Judge Michael H. Watson to throw out two pieces of heavy equipment. They claim local and state law enforcement used a search warrant that was based on a false affidavit and authorities exceeded the scope of the warrant during an excessively long search.
Federal prosecutors have countered saying the agents did act within their authority and state law when they took the machinery after easily observing the vehicles’ identification numbers were either altered or destroyed.
