New filings submitted in wind proceedings

Former judge asks to be removed from case

A former judge and his wife have asked to be removed as parties to the appeal against EverPower Wind Holdings’ plan to build a local wind development as the company responds to two separate legal motions.

John L. Ross and Frances Ross filed a motion last week that they did not wish to be listed among a group of Indian Lake residents asking the Ohio Power Siting Board to reconsider its decision to issue a permit to install up to 176 wind turbines in six townships in northern southern Logan and Hardin counties.

The document, filed by Columbus lawyer Mark S. Yurick, said Mr. and Mrs. Ross were “inadvertently added as potential intervenors in these proceedings without their knowledge or approval and do not wish to be further involved in this matter.”

Mr. Ross is a retired Bellefontaine Municipal Court judge.
